Digital Communication in the time of Corona (Covid-19 Pandemic)
Since corona virus (Covid-19) has been pervaded everywhere India is not an exception. More over it has shaken entire world. As a result many people are met with demise and other are in the dire stage. It is the matter of grave concern because entire Nation is on the verge of distruction.
Consequently, Government declared lockdown in entire country so much so that recently lockdown has been extended upto 3rd may of 2020 due to rapid growth of COVID-19 in order to curb it.
Now, video conferencing is the need of hour and it is being used extensively by Educational Institutions, Corporate Sectors and Government like the Bombay High court to conduct hearings through video conferencing with the Zoom Application until May 5 of 2020.
There are three popular platforms for Digital communication or video conferencing like Skype, webex and Zoom. Zoom application gained momentum and is being used as means of chatting/conferencing for various purposes such as online classes, online meetings, conferences and other allied purposes and has become favourite among the people.
Right to privacy v/s Zoom Application
Article 21 of Indian Constitution provides Right to privacy is a fundamental right. In this context the 9 - Judges bench of Justice K.S. Puttaswami (Retd.) v/s Union of India unanimously held that “the right to privacy is protected as an integral part of the right to life and personal liberty under Article 21 and also overruled previous judgements of the Supreme Court in Kharak Singh vs State of UP and M.P Sharma vs Union of India, which had held that there is no fundamental right to privacy under the Indian Constitution. Therefore, now Right to privacy is a fundamental right.
As zoom application based on US technology and according to researchers it has some companies in china but china does not use this app even blocked it. So much so that Taiwan also Banned for the government use. Now question arises that whether use of Zoom app is safe or not ? In this reference the Ministry of Home affairs (MHA) has issued an advisory that zoom video conferencing is not a safe platform and also warns about using zoom app more over MHA has asked to government not to use zoom for meetings.
Above all, Recently A Letter petition has been filled to the Chief Justice of India SA Bobde regarding the infringement of fundamental Right to Privacy on account of permitting the use of ZOOM application, and seeks for the ban on its download and usage also.
Conclusion
It is manifest that Digital comunication is the need of hour for the various purposes irrispective of corporate sector or government. Now time has come that India has to develop its own video conferencing/ meeting application and has to ban such type of application else future would be drastic.
